29 Sep Recent & Upcoming Changes to the Ontario Employment Standards Act
As of June 19, 2025 workers in Ontario now have access to an unpaid long-term illness leave of up to 27 weeks of leave in any 52 week period.
The leave does not need to be taken consecutively, which requires an employer in Ontario to accommodate an intermittent work and leave schedule for any employee that has had at least thirteen (13) weeks of continuous employment.
An employer will require a certificate from a qualified health practitioner confirming a serious medical condition and the period the employee is unable to work. Employers will need to align their policies and procedures manuals to align with this new legislation.
If you are an employer that needs guidance with ensuring that your policies are in compliance with the new long-term disability leaves and your company needs advice to ensure you are not infringing the Human Rights Code while accommodating the employee on one of these leaves when returning to work please reach out to our law firm.
